Agreement

These Terms of Service govern your use of the CrewFlow Technologies platform and services. By creating an account or using our services, you agree to these terms. If you are entering into these terms on behalf of a company or organisation, you represent that you have authority to bind that entity.

The service

CrewFlow provides an automated workforce communication platform that enables employer-clients to send shift reminders, coverage alerts, IVR confirmations, and payroll notifications to their employees via SMS and voice calls. The platform is provided as a software-as-a-service (SaaS) subscription.

Client obligations — employee consent

This is a critical obligation. You, as the employer-client, are responsible for: (a) obtaining valid, documented consent from every employee before adding them to the CrewFlow platform; (b) ensuring consent is collected through a clear opt-in process during HR onboarding; (c) maintaining records of consent for each employee; (d) removing employees from the platform promptly when they withdraw consent or leave your organisation; and (e) ensuring your use of the platform complies with all applicable employment and communications laws in your jurisdiction. CrewFlow is not responsible for communications sent to employees who have not provided valid consent. Clients found to be sending messages without proper consent will have their accounts suspended immediately.

Acceptable use policy

You may only use the CrewFlow platform for legitimate employer-to-employee workforce communication. Prohibited uses include: marketing or promotional messages to employees or any other recipients; cold outreach or lead generation; debt collection; gambling, adult content, or high-risk financial promotions; political campaigning; any communication that violates TRAI regulations (India) or applicable telecom regulations in your jurisdiction; and any use that could bring CrewFlow or its telecom partners into disrepute. Violation of this policy will result in immediate account suspension and may result in legal action.

Communications

CrewFlow may contact you by email, phone, and SMS for service-related purposes including account updates, billing notifications, and support communications. Where you have provided consent, we may also send you product updates and service announcements. You can opt out of non-essential communications at any time by contacting [email protected] or by replying STOP to any SMS message. Message and data rates may apply to SMS communications.

Subscription and billing

Subscriptions are billed monthly in advance. Prices are as listed on our pricing page at the time of subscription. We reserve the right to change pricing with 30 days' notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Data and privacy

Your use of the platform is also governed by our Privacy Policy. You grant CrewFlow a limited licence to process the employee data you provide solely for the purpose of delivering the communications you request. You remain the data controller for employee data. CrewFlow acts as a data processor.

Service availability

We aim to maintain platform availability of 99.5% or above. Planned maintenance will be communicated in advance. Enterprise clients with an SLA agreement are subject to the terms of that agreement. We are not liable for downtime caused by third-party telecom providers or circumstances outside our reasonable control.

Limitation of liability

To the maximum extent permitted by law, CrewFlow's liability to you for any claim arising from these terms or your use of the platform is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

Termination

Either party may terminate the subscription with 30 days' written notice. CrewFlow may suspend or terminate your account immediately if: you violate the Acceptable Use Policy; you fail to pay fees when due; or your use of the platform creates legal or regulatory risk for CrewFlow or its telecom partners. On termination, your data will be retained for 30 days and then deleted, unless you request earlier deletion.

Governing law

These terms are governed by the laws of India. For clients in the United Kingdom, United States, Canada, Australia, or New Zealand, any disputes will be subject to the jurisdiction agreed in your client agreement. In the absence of a specific agreement, disputes will be resolved under Indian law in the courts of Pune, Maharashtra.

Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
